Chapter 7 Bankruptcy
Chapter 7 bankruptcy can discharge most types of debt with the exception student loans and child support payments. Keeping your home or car after Chapter 7 is normally possible, but is something you should discuss with us.
Chapter 12 Bankruptcy
Chapter 12 bankruptcy is for farmers and fishermen – it can help out with farm-related debts and has a higher debt ceiling than Chapter 13. If you have farm-related or fishing business debt, ask us about Chapter 12.
Chapter 13 Bankruptcy
Chapter 13 bankruptcy is often called “wage-earner’s bankruptcy,” because it involves a debt repayment plan. It can help you keep things like your home and car, if you have a regular income you can demonstrate to the Court. Chapter 13 bankruptcy also works out a payment plan over a longer period of time, taking into account what you can handle on your income.
2005 Changes to Bankruptcy Law
As you may have heard, there were significant changes to the Bankruptcy Code made by Congress in 2005. A lot of people are confused about what it all means, and some think it has removed bankruptcy as an option. This is not true, but there are several new considerations.
